These Terms of Service (the “Terms”) govern your access to and use of ootify’s browser add‑on, website, and related services (the “Service”). By using the Service, you agree to these Terms.

1. The Service

ootify provides a browser overlay that helps you highlight products on e‑commerce sites, assemble outfits, and generate try‑on images using your photos. Some features operate locally in your browser; others may involve transmitting content to our servers or service providers to deliver results.

2. Your account and eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have consent from a parent or legal guardian. You are responsible for maintaining the confidentiality of any credentials and for all activities under your account.

3. User content and license

You may submit or upload images and other content to the Service (your “User Content”). You retain ownership of your User Content. You grant ootify a worldwide, non‑exclusive, royalty‑free license to host, process, reproduce, and display your User Content as necessary to operate and improve the Service, including to generate try‑on results, ensure safety, debug, prevent abuse, and comply with law.

For clarity, when you send images through our API for generation, we may store the images and associated metadata for a limited period to provide, maintain, and improve the Service, including safety review and abuse prevention. Do not upload sensitive or illegal content.

4. Acceptable use

• No unlawful, harmful, or infringing content.
• No attempts to reverse engineer, bypass security, or overload the Service.
• No scraping or automated access beyond documented interfaces.
• Respect third‑party site terms when using the overlay.

5. Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you consent to the processing described there.

6. Intellectual property

The Service, including software, UI, and content (excluding your User Content), is owned by ootify or its licensors and protected by law. Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable license to use the add‑on and site for personal, non‑commercial purposes.

7. Beta features

Some features may be offered as beta or experimental and may change, break, or be discontinued at any time. We may collect feedback to improve these features.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free, or that outputs will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, ootify and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability for all claims is limited to the greater of amounts you paid us in the 12 months prior to the event giving rise to the claim or USD $50.

10. Indemnity

You agree to defend, indemnify, and hold harmless ootify and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your breach of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we believe you violated these Terms. You may stop using the Service at any time. Upon termination, the rights and licenses granted to you will end.

12. Changes to the Service or Terms

We may modify the Service and these Terms. We’ll post updates with a new “Last updated” date and, when appropriate, additional notice. Continued use of the Service after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of your local jurisdiction unless otherwise required by applicable law. Venue for disputes will be in courts with proper jurisdiction over our principal place of business.
